ECHT - terms and conditions

1. Area of application

For all business relations between ECHT Schmuck und Design oHG, Heilsbachstr. 17-19, D-53123 Bonn, its legitimates Petra Luckau, Martin Grünewald and the customers only these general terms of trade are considered to be valid. Herewith ECHT Schmuck und Design oHG does not accept conflicting or from these terms divergent conditions from a customer and contradicts them strictly. Conflicting terms of trade of the customer are only valid if ECHT Schmuck und Design oHG agrees strictly and in writing.

2. Contracting partners

3. Completion of the contract

The presentation of the products in the on-line Shop or catalogue represents no legally binding offer, but a noncommittal catalogue and therefore only a demand on the order. Orders placed in the on-line-shop: after input of your individual data and by clicking the order button in the concluding step of the order process you place an obliging order of the goods contained in the goods basket. The contract of sale is valided by a confirmation of the incoming order which is done directly after sending the order unless the customer is contradicting. Orders placed from the printed catalogue or on fairs: by placing the order (individually, by telephone, fax or letter) you place an obliging order of the respective goods. There is no further order confirmation, except you place the order by telephone or personally. Should a customer get no confirmation of the order or delivery of the goods within two weeks after he placed the order, he is not bound any more to his order except an agreement about a later delivery was met.

4. Partial deliveries

ECHT is entitled to partial deliveries. There are no additional freight costs, only with explicit agreement and agreement from the customer.

5. Retention of title

The supplied goods remain our property up to full payment.

6. Countermand instruction

6.1 Countermand right
The customer can cancel his contract without reasons in text form (e.g. letter, fax, E-mail) or - if ECHT has sent you the goods already - by return of the goods. The countermand time is one month and begins at the earliest one day after receiving the countermand instruction and the getting of the goods. In no case the countermand time begins before the day on which the customer receives the goods. The countermand (e.g. letter, fax, E-mail) is to be directed to:

6.2 Countermand consequences
In the case of an effective countermand all advantages received on both sides have to be given back and if necessary all interests are to be given back vice versa. If you cannot give us back the advantages in whole or in part or the goods are in worsened condition only the customer must pay the worth as substitute. This is not so if the deterioration of the goods is due exclusively to a normal test. Incidentally you can avoid the worth deterioration if you do not use the goods as your property and refrain from everything what impairs their value. The goods must be sent back on the customer’s risk. He has to pay for the freight charge of the return if the goods that we sent to you are the same that you ordered. This regulation is only valid up to a goods value of 40 Euros. End of the countermand instruction

7. Prices and freight charges

The prices indicated do not contain the legal value added tax. This will be added if you do not have a legal VAT-no. which allows ECHT to use the net-prices only. Besides, the customer has to pay the freight charge. There is no COD (cash on delivery ) available outside of Germany. The normal payment is a pre payment by bank transfer. The freight charges for parcels outside of Germany must be asked for (e.g. by fax, E-Mail, Telephone).

8. Data storage

In accordance with §28 of the federal data protection law (BDSG) we point out to you the fact that the data that are necessary for the commercial processing are stored in accordance with §33 BDSG. Individual data are treated of course confidentially and are not transmitted by us to advertising purposes to others. We store your address and the data which are necessary to process your order. The customer can receive at any time information about his stored data and require the deletion of the data.

9. Terms of delivery

The delivery time is usually one to two workdays or unless there is a different agreement. ECHT tries to send the goods soonest after getting the order. If not all of the ordered goods are available ECHT delivers the available goods immediately unless there is a different agreement. The not available goods are not shipped later unless there is a different agreement.

10. Payment

The payment has to be done by pre-payment (bank transfer). ECHT also offers the customer to pay by PayPal.

11. Retention of title

The supplied goods remain the property of ECHT up to full payment.

12. Guarantee

Within two years after delivery faults can be indicated. The customer has the choice between correction of faults or new delivery by ECHT.

INDICATION: the guarantee does not refer to damages which appear from the retailer - or after - by the final customer. This refers, first of all, to gem stones and settings of these stones. These can be complained only if the customer gives back all fragments. This is founded in the fact that gem stones - particularly Zirkonia (mineral glass) - and their settings need only little violence to be destroyed. This may already happen by inappropriate use already while first wearing it. Therefore these products are intensely checked before ECHT sends them out.

13. Place of Jurisdiction

The only place of jurisdiction for both sides is Bonn. The laws of the Federal Republic of Germany are valid only, also for deliveries to foreign country and orders from abroad.

14. Final Clause

The possible ineffectiveness of separate parts of our Terms of Trade does not automatically cause their complete ineffectiveness. The ineffective parts will be exchanged to normal rules.
